V Visa (V-1, V-2)
Eligibility: Spouse (V-1): Beneficiary of an I-130 visa petition filed by PRA spouse. Petition must have been filed before 22 Dec 2000, and Beneficiary must have been waiting for an interview date for at least three years. Beneficiary can file for V status even if the petition has not been approved yet by INS. The receipt notice from INS will serve as proof of eligibility.
V Visa is not available for those who have been interviewed already, or already scheduled for a visa interview at the Consulate.
Child (V-2): Under 21, unmarried. Same requirement as above. Child can be included on the parent’s petition, or may have his/her own petition.
Benefit of V Visa: Approved applicants can go to U.S. and wait there till petition is current and then file for adjustment of status. Also, the V Visa is good as a multiple-entry visa for ten years. That means the applicants can go to the US and visit the PA and then return to Vietnam, as often as they wish during that ten year period.
